GENERAL CONDITIONS OF SALE

 

1. APPLICATION

Enjoy Molise is the trade name of the individual company Cinzia De Letis.

Our general sales conditions (GSC) apply to all orders placed on the website www.oltre-bio.it/Enjoy/ as well as via What's App and telephone number +39 339 18 74 367 or by email to enjoymolise[a]gmail.com. We recommend that you read our terms and conditions before placing an order on our ecommerce site. Our GTC are considered as implicitly accepted at the time of purchase.

Enjoy Molise reserves the right to modify its GTC and to publish them on its website at any time. All substantive changes are directly communicated to our customers via the usual channels.

2. IDENTIFICATION OF THE PARTIES (SELLER AND BUYER)

The seller Enjoy Molise, trade name of the individual company Cinzia De Letis, registered at the Chamber of Commerce of Campobasso (Italy) with legal seat: Lucito, Via G. Pepe 19 - 86030 (CB), company registration number 211189, VAT number 01842970707, tel. +39 339 18 74 367, email: cinziadeletis[a]gmail.com

Purchases on our e-commerce site can be made by all persons (buyers, customers) over 18 years of age. Our website is accessible to all visitors, however delivery is limited to certain European countries (see "Delivery" page). You must create an account on our website to place an order.

 
3. CREATION OF AN ACCOUNT

The creation of an account is done on the website www.oltre-bio.it/Enjoy/ before finalising an order by providing the main personal information (first name, last name), a valid email address and a telephone number as well as a personal password to access his account. The customer can access his account and data at any time. By registering, the customer acknowledges that he/she is of legal age and agrees to provide true personal data.

 
4. USE OF THE DATA

Enjoy Molise treats the personal data in the respect of the law as regards policy of private life as defined in detail in the notice of our policy of confidentiality.

 
5. DELETION OF THE CUSTOMER ACCOUNT

The customer who wishes to definitively delete his account can at any time make the request by email to enjoymolise[a]gmail.com by indicating in the subject of the email "Deletion of the customer account". Personal information (first name, last name and email address) is required to properly delete the account of the requesting customer. It may take a few days to process the request.

 
6. PRODUCTS (AVAILABILITY, PHOTO, LABELLING)

There are three statuses for products offered for sale on our website (visible on the product page): "In stock", "Available" and "Out of stock". In stock" means that the product is in stock. Available" means that the product is in stock at our local producer (longer shipping time). Finally, "Out of stock" means that you have to wait for a new production or a new arrival.

The photo used to illustrate a product on sale on our ecommerce belongs either to the producer or to Enjoy Molise. It is possible that in some cases we use a photo or an image free of rights which partially represents the product. In this case, the mention "photo/image as an indication" is clearly visible in the description of the product in question.

All mandatory information regarding the labelling of a product (ingredients, nutritional information, allergens...) is clearly displayed on the page of each product under the section "Description". These are available on our website in three languages (IT, FR, EN). The default language for the labelling of products is Italian. It is therefore possible that the buyer receives a product with a label in Italian only. Therefore, the buyer is obliged to find out about the composition and characteristics of the product before making a purchase on our website. Furthermore, the buyer is invited to consult the web page of the purchased product if necessary. The buyer can obtain a translation of the label of a product purchased on our website in French or English by simply sending an email to enjoymolise[a]gmail.com.

Enjoy Molise is not responsible for the information provided by the producers (ingredients, expiry date, etc.).

7. PURCHASE OF PRODUCTS

Any visitor who is at least 18 years old and who visits our ecommerce site www.oltre-bio.it/Enjoy/ is allowed to create an account and to make purchases provided that the delivery address indicated is located in Europe and in one of the countries available for delivery. The order will be processed by us within 24 hours. The delivery time may vary depending on the availability of the products and the delivery address.

To finalise the order, the customer must create or log in to their account, accept our terms and conditions and make the payment. The customer undertakes to regularly check their details (postal address, email and telephone number) necessary for the correct delivery of the parcel.

It is also possible to place an order by phone or by What's App message to +39 339 18 74 367 in which case the customer will receive an order confirmation message/email and a payment link.

7.1. Order confirmation and tracking

An automatic order confirmation email is sent to the email address linked to the customer's personal account. The order is validated/shipped only after the payment has been received. If the ordered products are no longer available or if the delivery data are incomplete, we will inform the customer by phone or e-mail.

7.2. Occasional sales in Belgium

Our online grocery shop doubles as a mobile grocery shop about twice a year with occasional direct sales in Belgium. These occasional sales have the particularity that both the transport and the delivery to the home or to a collection point is done by us. Customers can place an order during these occasional sales via our different sales channels (website, messaging and telephone) within a defined time period which is communicated in our newsletter and visible on our ecommerce. Specific transport options will then be temporarily available. These are only intended for customers who wish to receive their parcel in Belgium, at home or at a collection point, on the dates communicated.

 
8. MINIMUM ORDER AND PRICE

The minimum order value is € 20.00 (VAT included). All prices displayed on our website are in Euros and include VAT. Delivery costs are not included in the prices. See the "Delivery" page for prices.

 
9. METHOD AND CONDITION OF PAYMENT

Payments can be made by bank transfer, credit/debit card or other options managed by STRIPE. All our payment options are free of charge for our customers. Online payments are fully secured by the STRIPE payment platform. For the bank transfer option, an automatic email is sent to the customer with all relevant information.

 
10. PROOF OF PURCHASE

The proof of purchase or receipt or invoice is included in each package. It is also sent automatically by email to the customer, once the payment has been validated. The personal details provided by the buyer at the time of registration are included on the proof of purchase.

 
11. TRANSPORT AND DELIVERY

Orders are prepared and packed by us. The packages are then entrusted to the DHL transport company for deliveries outside Italy and to the SDA company (via the Truckpooling platform) for deliveries in Italy (including Sardinia and Sicily). It is important to indicate or choose the correct address where the delivery should take place and a valid telephone number in order to contact the recipient in case of problems.

We recommend that you pay particular attention to choosing the delivery option corresponding to the delivery address. In the event of an error, the order will be suspended until the customer is notified of his or her choice of the following solutions: payment of any additional delivery costs, a modification of the order or a refund in the form of a voucher valid for 1 year.

At the time of delivery, the customer is obliged to check that the number of packages corresponds to that indicated in the transport document and that the packaging is intact, undamaged, wet or open.

Any damage to the packaging and/or the products or an incorrect number of packages must be reported immediately to the employee making the delivery. In such a situation, it is imperative that the customer accepts the goods with reservation and contacts us immediately by e-mail at enjoymolise[a]gmail.com or by phone at +39 339 18 74 367.

The order will be dispatched within 5 days (Sundays and public holidays excluded) after confirmation and payment of the order, unless one or more products are not available immediately.

All prices are quoted in Euros and include VAT. Delivery costs are not included in the price. Delivery costs are calculated automatically according to the address, weight or amount of the order.

11.1 Liability

The goods travel at the risk of the customer. Enjoy Molise will not be responsible for possible delays. Enjoy Molise cannot be held responsible in case of possible losses, damages, cancellation of delivery due to an event or for cause of force majeure or for cases such as (as an example): natural calamities, bad weather conditions, strikes, accidents of the means of transport, explosions, etc.

Enjoy Molise commits itself to respecting the laws on hygiene and the AFSCA (HACCP in Italy) standards until the moment of the handing over of the package to the transport company (or the delivery in the announced places). All responsibilities due to the bad conservation of the food are excluded.

Orders will not be refunded under any circumstances. After evaluation of the circumstances, Enjoy Molise could grant a total or partial refund of a problematic order in the form of a voucher valid for 1 year.

11.2. Transport/delivery in Belgium in the context of an occasional sale

In the case of occasional sales, the transport and delivery of the orders in Belgium is carried out by Enjoy Molise under the risk of the customer. The delivery is guaranteed only to the announced collection points or to an address located in Brussels or in Wallonia. The delivery dates and possible time slots are communicated at each opening of sale on our website and in the newsletter (FR).

If the customer encounters an unforeseen problem and is unable to collect the order in time from the selected collection point, he/she is requested to contact us immediately by telephone on +39 339 18 74 367 in order to find an alternative solution.

In case of unforeseen circumstances for Enjoy Molise, each customer will be informed individually in order to find an alternative solution.

 
12. RIGHT OF WITHDRAWAL

According to the Italian law of art. 55, comma 1 lett. a), del D. Lgs. 6 September 2005, n. 206 (Consumer Code) the right of withdrawal does not apply

a) to contracts for the supply of foodstuffs, beverages or other household items of everyday consumption supplied to the consumer's home, place of residence or place of work, by distributors who make frequent and regular rounds;

and according to Art. 55(2)(c) the right of withdrawal cannot be exercised in the case of delivery of goods which are custom-made or clearly personalised, or which by their nature cannot be returned or are likely to deteriorate or expire rapidly.

Considering that all food products fall into the category of products that are "liable to deteriorate or expire rapidly" because the characteristics and qualities of these types of products are subject to change also due to improper storage, thus for reasons of hygiene and for the protection of the customer, the right of withdrawal is not applicable. Returns are therefore not accepted.

 
13. JURISDICTION UNDER APPLICABLE LAW

The formation, existence, interpretation, execution, validity and all aspects relating to these conditions of sale are governed by Italian law.

Jurisdiction for the settlement of any dispute arising from, or related to, these Terms of Sale or use of the Site www.oltre-bio.it/Enjoy/ is exclusively vested in the Court of Campobasso.
